Virginia’s largest school insurer says worker’s compensation is unlikely for teachers who catch COVID-19
There are many things to consider with the return of the school year. RHD works to protect the rights of Virginia workers. We are concerned that some plans for students returning to schools leave teacher without sufficient protections if they contract COVID-19. Insurance carriers have all but stated they will deny work comp claims for teachers who contract COVID after returning to the classroom, and now some Virginia legislators also want to deny them the right to sue for the damage from a disease that cause lifelong injury or death. According to a recent Virginia Workers’ Compensation ruling, employees who suffer psychological injuries on the job can receive workers’ compensation benefits. Andrew Reinhardt represented the employee, Thomas Faigle, during the review of this case regarding the shooting that took place at New River Community College in 2013. He pointed towards other situations where one may suffer from psychological pain such as tellers during bank robberies and law enforcement officers who suppress psychological pain suffered in the line of duty. Due to this ruling, the hope is that moving forward, employers will be more prepared and equipped to handle these cases for their employees. To read the full article, click here.
